NDIS SERVICE AGREEMENT

Assistance with Self-Care Activities

1. Parties

This Service Agreement is made between Julie Tenner (“the Provider”) and the NDIS participant named below (“the Participant”) for the provision of NDIS-funded supports.


This Service Agreement is made in the context of the National Disability Insurance Scheme (NDIS), which aims to:

  • support the independence and social and economic participation of people with disability

  • enable people with disability to exercise choice and control in the pursuit of their goals and the planning and delivery of their supports.


The supports provided under this agreement are intended to assist the Participant in working towards their individual NDIS goals while supporting choice, autonomy, capacity and participation in everyday life.

2. Schedule of Supports

Services under this agreement will be provided under:

NDIS Support Item: 01_011_0107_1_1


Assistance with Self-Care Activities – Standard – Weekday Daytime


Funding Category: Core – Assistance with Daily Life


Rate: $73.58 per hour


Support may include individual assistance that helps the Participant with their everyday functioning, independence, capacity, wellbeing and participation, in accordance with their NDIS goals and the scope of this support item.


The specific nature of support will be discussed collaboratively with the Participant and may change according to their needs, circumstances and goals.


Services will be charged according to the time spent providing the agreed support.


The hourly rate may change if the NDIS Pricing Arrangements and Price Limits are updated. Where applicable, services will be charged at no more than the current NDIS price limit for the relevant support item.

3. Responsibilities of the Provider

The Provider agrees to:

  • provide services with care, respect and professionalism

  • provide supports that are appropriate to the Participant’s needs and agreed NDIS goals

  • respect the Participant’s autonomy, preferences, dignity and right to make their own choices

  • communicate openly and honestly

  • involve the Participant in decisions about how their supports are provided

  • listen to feedback and address concerns in a timely manner

  • provide reasonable notice if a scheduled appointment needs to be changed or cancelled

  • protect the Participant’s privacy and confidential information

  • maintain appropriate records relating to services provided

  • provide invoices that accurately reflect services delivered

  • provide supports in accordance with relevant Australian and Victorian laws and applicable NDIS requirements.


4. Responsibilities of the Participant

The Participant and/or their representative agrees to:

  • communicate their needs, preferences and goals to the Provider

  • provide relevant information required for supports to be provided safely and appropriately

  • treat the Provider with courtesy and respect

  • raise any concerns about the services being provided

  • provide the required notice if they are unable to attend a scheduled appointment

  • pay invoices or arrange for their Plan Manager to pay invoices within the required timeframe

  • advise the Provider if there are changes to their NDIS plan or funding that may affect the provision of services

  • advise the Provider if their NDIS plan is suspended, replaced or they cease to be an NDIS participant

  • provide the required notice if they wish to end this Service Agreement.


5. Payments

Self-Managed Participants

Where the Participant self-manages their NDIS funding, an invoice will be issued for services provided.

The Participant is responsible for ensuring that sufficient NDIS funding is available and for paying invoices within the stated payment terms.


Plan-Managed Participants

Where the Participant's funding is plan-managed, invoices will be sent to the nominated Plan Manager.


The Participant remains responsible for notifying the Provider of any changes to their Plan Manager or funding arrangements.

Services may be paused where invoices remain unpaid or the Provider is advised that sufficient funding is unavailable.

6. Cancellations

The Participant is asked to provide as much notice as possible if they are unable to attend a scheduled support session.


Where a cancellation meets the requirements for a short-notice cancellation of 48 hours under the current NDIS Pricing Arrangements and Price Limits, up to 100% of the agreed session fee may be charged to the Participant’s NDIS funding.


Cancellation charges will only be applied where permitted under current NDIS rules.

Where possible, consideration will be given to unforeseen or exceptional circumstances.

Repeated missed appointments may result in the regular appointment time being released or the suitability of the current support arrangement being reviewed.


7. Changes to this Agreement

The Participant's needs and circumstances may change over time.

If changes are required to the supports, frequency of services, funding arrangements or other aspects of this agreement, the Participant and Provider will discuss these changes together.


Any significant changes to this Service Agreement should be agreed to by both parties.


A new Service Agreement may be completed when the Participant receives a new NDIS plan or where there is a significant change to the services being provided.


8. Ending this Service Agreement

Either the Participant or Provider may end this Service Agreement by providing reasonable written notice.

Where possible, one month's notice is requested to allow services to be concluded appropriately.

The notice period may be waived where:

  • both parties agree

  • funding is no longer available

  • the Participant is no longer eligible for the relevant NDIS support

  • there is a serious breach of this agreement

  • continuing to provide services would create an unacceptable safety or professional risk.

Any outstanding invoices for services already provided remain payable.


9. Privacy and Confidentiality

The Provider will respect the Participant's privacy and keep personal information confidential in accordance with relevant privacy legislation and professional obligations.

Information may be shared where:

  • the Participant has provided consent

  • it is reasonably necessary to coordinate agreed supports

  • disclosure is required by law

  • there is a serious concern regarding safety that requires disclosure.

Where appropriate, the Provider will discuss information sharing with the Participant.


10. Feedback, Complaints and Disputes

The Participant is encouraged to raise any feedback, concerns or complaints directly with the Provider so they can be addressed wherever possible.

If the Participant does not feel comfortable raising the matter directly with the Provider, or is not satisfied with the response, they may contact the relevant external complaints body, including the NDIS Quality and Safeguards Commission.

The Participant will not be disadvantaged or have their services negatively affected because they make a complaint or provide feedback.


11. Emergency and Crisis Support

The services provided under this agreement are not an emergency or crisis response service.

If the Participant requires urgent medical assistance or there is an immediate risk to safety, emergency or appropriate crisis services should be contacted.
